Data Protection Declaration

Optris GmbH, Ferdinand-Buisson-Str. 14, 13127 Berlin (hereafter referred to as “Optris” or “we/our”) takes the protection of your personal data very seriously and complies strictly with all applicable data protection laws and regulations, in particular with the General Data Protection Regulation, (GDPR), the German Federal Data Protection Act (FDPA) and the German Telemedia Act (TMA). The following explanations give you an overview of how Optris ensures this protection and which data we process for what purpose.

1. Usage Data

General data are saved in a log file by an automatic process every time our website is accessed or a file is called up. The storage exclusively serves system-related and statistical purposes (based on Art. 6 Para. 1 Letter b) GDPR), as well as in exceptional cases to report crimes (based on Art. 6 Para. 1 Letter e) GDPR).

A transfer of the data to a third party or any other analysis does not take place, unless a legal obligation to do so exists.

In detail, with every call the following data record is saved:

  • Name of the file called
  • Date and time of the call
  • Transmitted data volume
  • Report as to whether the call was successful
  • Description of the type of web browser used
  • Operating system used
  • The site previously visited
  • Provider
  • IP address of the user

2. Personal Data

a. Contact

When you contact us, we save your data based on Art. 6 Para. 1 Letter b) GDPR for the purpose of processing your request, as well as in case further correspondence is to take place.

b. Newsletter

We are pleased to inform you about our company and our range of products via our newsletter.

To send a newsletter we require your title, your name and your email address. You can enter these details in the fields provided for this purpose. After you have sent this data, you will receive an email from us sent to the email address specified by you, in which you must click on a confirmation link to verify the email address that you specified.

Your data will only be processed by us for the purpose of sending the newsletter.

You can unsubscribe from the newsletter at any time and thereby veto the further use of your data. To do this, you can remove yourself from the mailing list at the end of every single newsletter. Alternatively you can also send us an email to info@optris.de.

c. Requesting Brochures

With our “Request brochures” form provided on the website, we offer the option of ordering brochures, technical trade articles and application articles, with which we provide you in printed form. For this, the specification of a title, your first name and surname, the address and a valid email address is required, so that we know from whom the request originates and will be able to answer it. Further details can be given voluntarily.

The processing of data for the purpose of preparing an offer with us takes place according to Art. 6 Para.1 Letter b GDPR based on your concrete request.

The personal data we collect for the use of the form are automatically deleted after completion of the inquiry you have made, unless another basis for legitimacy (e.g. a concrete order) entitles us to process the data further.

Insofar as you subscribe to our newsletter in the form via the additional option, 2b) applies as supplementary.

d. Request for an Offer

For the creation of concrete offers, we provide you with the option of contacting us by means of a form “Create offers” provided on the website. For this, the specification of a title, your surname and a valid email address are required, so that we know from whom the request originates and will be able to answer it. Further details can be given voluntarily.

The processing of data for the purpose of preparing an offer with us takes place according to Art. 6 Para.1 Letter b GDPR based on your concrete request.

The personal data we collect for the use of the contact form are automatically deleted after completion of the inquiry you have made, unless another basis for legitimacy (e.g. a concrete order) entitles us to process the data further.

e. Contract Processing

The data you provide to us for the purpose of contract processing are processed exclusively by us for this purpose, and if necessary transferred to the company involved in the contract processing (suppliers, carriers). Legal basis for this data processing is your consent and therefore Art. 6 Para. 1 Letter a) GDPR.

3. Cookies

In some areas of our website we implement so-called cookies. By means of such file elements, your computer can be identified as a technical unit during your visit to this website, in order to facilitate the use of our offers for you, also when you make repeat visits. Consequently, a cookie is required, for example, to be able to provide you with a function such as the Product Configurator.

However, as a rule you have the option of configuring your Internet browser to inform you about the occurrence of cookies, enabling you to permit or exclude these, or respectively to delete already existing cookies.

4. Web Analysis - Google Analytics

This website uses Google Analytics, a web analysis service of Google Inc. (“Google”). Google Analytics uses so-called “cookies”, text files that are stored on your computer and which enable an analysis of your usage of the website. The information generated by the cookie about your usage of this website is normally transmitted to a Google server in the USA and stored there. However, in the event that IP anonymization is activated on this website, your IP address is truncated beforehand by Google within member states of the European Union or in other signatories to the Treaty on the European Economic Area. Only in exceptional cases is the full IP address transmitted to a Google server in the USA and truncated there. On our behalf, Google will use this information to analyze your usage of the website, to compile reports about the website activities and to produce other services for us associated with the usage of the website and the Internet. The IP address transferred by your browser within the framework of Google Analytics is not merged with other data by Google. We base the application of the aforementioned analysis tools on Art. 6 Para. 1 Letter f) GDPR: the processing takes place to analyze the usage behavior, as well as for marketing and optimization purposes and is therefore required to safeguard our legitimate interests.

5. Google AdWords with Conversion Tracking

Our website uses Google AdWords and conversion tracking. This is a service provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043 (hereinafter: Google).

Google guarantees that it will follow the EU’s data protection regulations when processing data in the United States.

We use conversion tracking to provide targeted promotion of our site. The legal basis is Art. 6 Para. 1 lit. f) GDPR. Our legitimate interest lies in the analysis, optimization, and economic operation of our site.

If you click on an ad placed by Google, the conversion tracking we use stores a cookie on your device. These so-called conversion cookies expire after 30 days and do not otherwise identify you personally.

If the cookie is still valid and you visit a specific page of our website, both we and Google can evaluate that you clicked on one of our ads placed on Google and that you were then forwarded to our website.

The data collected in this way is in turn used by Google to provide us with an evaluation of visits to our website and what visitors do once there. In addition, we receive information about the number of users who clicked on our advertisement(s) as well as about the pages on our site that are subsequently visited. Neither we nor third parties who also use Google AdWords will be able to identify you from this conversion tracking.

6. Youtube

We use YouTube on our website. This is a video portal operated by YouTube LLC, 901 Cherry Ave, 94066 San Bruno, CA, USA, hereinafter referred to as “YouTube”.

YouTube is a subsidiary of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA, hereinafter referred to as “Google”.

Google and its subsidiary YouTube guarantee that they will follow the EU’s data protection regulations when processing data in the United States.

We use YouTube in its advanced privacy mode to show you videos. The legal basis is Art. 6 Para. 1 lit. f) GDPR. Our legitimate interest lies in improving the quality of our website. According to YouTube, the advanced privacy mode means that the data specified below will only be transmitted to the YouTube server if you actually start a video.

Without this mode, a connection to the YouTube server in the USA will be established as soon as you access any of our webpages on which a YouTube video is embedded.

This connection is required in order to be able to display the respective video on our website within your browser. YouTube will record and process at a minimum your IP address, the date and time the video was displayed, as well as the website you visited. In addition, a connection to the DoubleClick advertising network of Google is established.

If you are logged in to YouTube when you access our site, YouTube will assign the connection information to your YouTube account. To prevent this, you must either log out of YouTube before visiting our site or make the appropriate settings in your YouTube account.

For the purpose of functionality and analysis of usage behavior, YouTube permanently stores cookies on your device via your browser. 7. Using Google Tag Manager

Our website uses the Google Tag Manager. The provider of this service is Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. This service allows website tags to be managed through an interface.

The Google Tool Manager only implements tags. This means that no cookies are used and no personal data is collected. The Google Tool Manager triggers other tags, which in turn may collect data. However, the Google Tag Manager does not access this data. If a deactivation has been made at domain or cookie level, it will remain in effect for all tracking tags to the extent that these are implemented with the Google Tag Manager.

8. Use of LinkedIn Pixel

We use conversion tracking technology on our website and the retargeting feature of LinkedIn Corporation. The provider is LinkedIn Ireland Unlimited Company, Wilton Place, Dublin2, Ireland.
This technology allows visitors to this website to see personalised advertisements displayed on LinkedIn. It also provides the ability to generate anonymous reports on ad performance and website interaction information. LinkedIn Insight tag is embedded in this website, which connects to the LinkedIn server when you visit this website and are logged into your LinkedIn account.

9. Google Dynamic Remarketing

In addition our website uses so-called retargeting technologies. We use these technologies to design our Internet offer to make it more interesting for you. This technique enables us to attract Internet users who have already shown an interest in our site with advertising on the websites of our partners (e.g. Google). We are convinced that as a rule the insertion of personalized, interest-related advertising is more interesting for the Internet user than advertising that has no such personal reference. The insertion of this advertising material on the sites of our partners takes place based on cookie technology and an analysis of the previous usage behavior. This form of advertising takes place completely pseudonymously. Of course, no personal data are saved during this process. The retargeting technology is carried out observing the applicable statutory data protection regulations.

This is how we use Google Dynamic Remarketing. This technology attracts users who have already visited our website to the sites of the Google partner network by means of targeted advertising. The insertion of the advertising is carried out as described above, by the application of cookies, with the help of which user behavior is analyzed during the visit to the website and can then be used for targeted product recommendations and interest-based advertising.

10. Use of Google Maps

Our website uses the Google Maps map service to integrate and display map content. The provider of this service is Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

When you call up a page with integrated map from Google Maps, your IP address is recorded. This information is usually transferred to a Google server in the USA and stored there. Google learns your IP address even if there is no user account through which you are logged in. If you are logged into your user account, Google can assign your surfing behaviour directly to your personal profile. You have the possibility to prevent this by logging out beforehand. The provider of this site has no influence on this data transmission.

The use of Google Maps is in the interest of an attractive presentation of our online offers and easy findability of the places we have indicated on the website. This represents a legitimate interest in the sense of Art. 6 Para. 1 lit. f DSGVO.

11. Storage Duration

The data that we have stored are deleted as soon as you revoke a possible consent or if the data are no longer required for their intended purpose and no legitimate interests or statutory storage obligations prevent the deletion.

Insofar as the data are not deleted, because they are required for other / legally permitted purposes, their processing is restricted. I.e. the data are blocked and not used for other purposes. That applies for example to user data that must be stored for reasons of commercial or fiscal law.
According to legal requirements, the storage takes place for 6 years as specified by § 257 Para. 1 German Commercial Code (HGB) (e.g. commercial correspondence, accounting records, etc.) as well as for 10 years as specified by § 147 Para. 1 Tax Code (AO) (e.g. commercial and business correspondence, tax-relevant documents).

12. Rights of Data Subjects

a. Right to Information

You have the right to demand from us a confirmation about whether personal data concerning you are processed.

b. Correction/Deletion/Limitation of Processing

Furthermore, you have the right to demand from us that
•    incorrect personal data concerning you are corrected immediately (right to correction);
•    personal data concerning you are deleted immediately (right to deletion) and
•    the processing is limited (right to limit the processing).

c. Right to Data Portability

You have the right to receive personal data concerning you that you have provided to us, in a structured, common and machine-readable format and to transfer this data to another responsible person.

d. Right of Revocation

You have the right to revoke your consent at any time. The legitimacy of the processing that has taken place until revocation, based on the consent, is not affected by the revocation of the consent.
